Terms of Service

The plain-language agreement between you and Daakiya.ink LLC when you subscribe.

These Terms of Service ("Terms") govern your access to and use of daakiya.ink and the Daakiya subscription service (together, the "Service"), operated by Daakiya.ink LLC, a Texas limited liability company ("Daakiya", "we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and who is agreeing to these Terms

Daakiya is designed for children, but the Service, the website, the purchase, and this agreement are intended for use by adults on a child's behalf. By using the Service, you represent that you are at least 18 years old, or the age of majority where you live, and that if you are providing information about a child you are that child's parent or legal guardian, or otherwise authorized to provide that information on their behalf and consent to our Privacy Policy and these Terms for them. Children should not create accounts, submit information, or make purchases on daakiya.ink directly.

2. The Service

Daakiya delivers letters written in the voice of our fictional character Amaya, mailed to a child specified by the subscribing parent or guardian. The letters are a creative, fictional product for entertainment purposes. Amaya is a fictional persona; the letters do not represent real correspondence, and nothing in the Service should be understood as factual claims about real-world events, organizations, or persons. We reserve reasonable creative discretion over the content, story arc, and pacing of each letter, within the general theme described on our website at the time you subscribe.

3. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Please provide accurate, current information, including your child's mailing address, and keep it up to date. Contact us immediately at support@daakiya.ink if you believe your account has been compromised.

4. Billing, auto-renewal and cancellation

Please read this section carefully. It explains how your subscription is billed.

Unless otherwise stated at checkout, Daakiya's monthly subscription is a recurring, auto-renewing plan billed at $10 per month. By subscribing and providing a payment method, you authorize us to automatically charge that payment method $10 on a recurring monthly basis until you cancel. A one-time single letter is available for $12 as a single, non-recurring purchase that does not renew or bill again. We disclose which option you are purchasing, its price, billing frequency, and cancellation terms clearly before you complete checkout.

How to cancel. You can cancel your monthly subscription at any time, either through your account settings on daakiya.ink or by emailing support@daakiya.ink. There is no cancellation fee. Whether a given month is refundable depends on when you cancel; see our Refund Policy. Cancel before the 25th of the month to avoid the next charge and shipment entirely. Cancelling on or after the 25th stops future billing, but the next letter, if already in production, follows the standard no-returns rule.

Sales tax. Prices listed are exclusive of any applicable sales tax, which is calculated based on your shipping address and added at checkout where required.

Price changes. If we change the price of your subscription, we will notify you by email at least 30 days before the new price takes effect. Continuing your subscription after that date means you accept the new price, and you can always cancel before a price change takes effect.

Free trials. We do not currently offer a free trial. If we introduce one, we will clearly disclose the trial length, the price that applies once it ends, and how to cancel before being charged, before you provide payment information.

5. Gift Letters and Keepsake Year

Gift Letters are prepaid, fixed-term gift subscriptions, available as a 3-month plan for $30, a 6-month plan for $58, or a 12-month plan for $110. They are billed once at checkout, do not auto-renew, and simply end after the final letter in the term ships.

Keepsake Year is a custom-priced, made-to-order annual keepsake book. We confirm the final price with you before you are charged. Once you approve that price and production begins, the order is final except as described in our Refund Policy.

6. Shipping and refunds

Shipping timelines and what happens if a letter is lost, delayed, or damaged are set out in our Shipping Policy. Cancellations, returns, and refund eligibility, including the 25th-of-the-month deadline, are set out in our Refund Policy. Both are part of these Terms.

7. Content your child sends us

If your child writes back to Amaya by mail, you, as the account holder, grant us a limited license to read and retain that letter in order to personalize future correspondence, as described in our Privacy Policy. We will not publish or use the substance of a child's letter publicly without a parent's separate, explicit opt-in consent.

8. Intellectual property

All content we provide through the Service, including the Amaya character, story lines, illustrations, the Daakiya name and logo, and the website itself, is owned by Daakiya.ink LLC or our licensors and protected by copyright, trademark, and other intellectual property laws. Subscribing gives you a personal, non-transferable, non-commercial license to receive and enjoy the letters for your family's use. You may not reproduce, distribute, publicly perform, create derivative works from, or commercially exploit our content without our prior written permission, though we are always happy to see a child's own letters, drawings, or reactions shared for personal, non-commercial purposes with appropriate credit.

If you believe content on daakiya.ink infringes your copyright, contact support@daakiya.ink with a description of the work, its location on our site, and your contact information, and we will investigate.

9. Acceptable use

You agree not to use the Service for any unlawful purpose, to misrepresent your identity or a child's information, to interfere with the operation of daakiya.ink, or to attempt to access accounts or data that are not yours.

10. Disclaimers

The Service is provided "as is" and "as available". We do not guarantee that the website will be uninterrupted or error free, or that any specific delivery date will be met, given our reliance on third-party postal services. Daakiya is an entertainment and creative correspondence product; it is not educational, medical, psychological, or counseling advice or services, and Amaya's letters should not be relied on as such. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Daakiya.ink LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability where the law does not allow it to be limited.

12. Indemnification

You agree to indemnify and hold Daakiya harmless from claims, damages, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Service, or information you provide to us being inaccurate or that you were not authorized to provide.

13. Dispute resolution and governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing a claim, you agree to first try to resolve the dispute informally by contacting support@daakiya.ink. Subject to that, any dispute not resolved informally will be brought in the state or federal courts located in Texas, and you consent to personal jurisdiction there.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify subscribers by email and update the date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Termination

We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or abusive behavior, or for other legitimate business reasons, with notice where practical. You may stop using the Service and cancel your subscription at any time as described above.

16. Force majeure

We are not responsible for delays or failures in performance caused by events outside our reasonable control, including postal service disruptions, customs delays, natural disasters, labor disputes, or other similar events.

17. General

If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and Daakiya regarding the Service.
