Privacy Policy

Daakiya ("Daakiya", "we", "us", "our") operates the website daakiya.ink and the subscription service described there (the "Service"), operated by Daakiya.ink LLC, a Texas limited liability company. This Privacy Policy explains what personal information we collect, how we use and share it, and, because our subscribers are children, the specific protections that apply to a child's information. By using daakiya.ink or subscribing to Daakiya, you agree to this Privacy Policy.

daakiya.ink is intended for use by parents and legal guardians ("you", "parent"), not by children. We do not knowingly collect personal information directly from a child through our website. Any information about your child that we hold is provided to us by you, the parent or guardian, when you create or manage a subscription.

1. Information we collect

From you, the parent or guardian, directly

• Name, email address, mailing and billing address, and phone number if provided
• Payment information, processed by our payment processor. We do not store full card numbers on our own servers.
• Account and order history, and any messages you send our support team

About your child, which you provide to us

• First name or nickname, age or age range, and the mailing address the letter should be sent to
• Optional personalization details you choose to share, for example interests or pronouns, so Amaya's letters feel personal
• We intentionally collect the minimum needed to personalize and deliver the Service. We do not ask for your child's school, exact date of birth, photo, or other identifying details beyond what is needed to address and personalize a letter, unless a specific optional add-on requires it and asks for your separate consent at that time.

Automatically, through the website

• IP address, browser and device type, and general usage data such as pages visited and referring site, collected via standard analytics and cookies, to help us run and improve daakiya.ink
• These technologies are used on the parent-facing website only, not embedded in anything a child would use directly

2. How we use information

We use the information above to create and manage your subscription; personalize and produce your child's letters, Gift Letter mailings, and Keepsake Year book; process payment and ship orders; communicate with you about your account, orders, and support requests; with your consent, send you marketing emails about Daakiya, which you can opt out of at any time; maintain the safety of children who correspond with us; and comply with legal, tax, and accounting obligations.

We do not use your child's personal information for targeted or behavioral advertising, and we do not build advertising profiles about children.

3. Children's privacy notice (COPPA)

• Our website is directed to and intended for use by parents and legal guardians, who create the account, provide payment, and submit any information about the child. Children do not create accounts, log in, or submit forms on daakiya.ink themselves.
• Because you, the same parent or guardian providing payment and account details, are the person who voluntarily submits your child's information for the specific purpose of receiving a personalized mailed product, your act of subscribing and providing that information constitutes your consent to our collection and use of it for that purpose.
• We collect only the information about your child that is reasonably necessary to provide the Service, and do not condition participation on providing more than that.
• We do not sell your child's personal information, and we do not share it with third parties for their own marketing or advertising purposes. We share it only as needed to produce and ship the letter.
• You can review the personal information we hold about your child, ask us to correct it, or ask us to delete it and cancel further collection, at any time, by emailing support@daakiya.ink. We honor deletion requests promptly, subject to any records we are legally required to retain.
• We retain a child's personal information only for as long as your subscription is active plus a reasonable period afterward for customer service, legal, and accounting purposes, after which we delete or de-identify it.
• If you believe we have collected more information about a child than described here, contact support@daakiya.ink and we will address it directly.

4. How we share information

We share personal information only with service providers who need it to help us operate the Service, under confidentiality and data-protection terms, including our e-commerce and payment platform, shipping and postal partners, email and communications tools we use to reach you, and hosting and website-analytics providers. We may also disclose information if required by law, to protect the rights, safety, or property of Daakiya or others, or in connection with a business transfer such as a merger or acquisition, in which case affected users would be notified.

We do not sell personal information, as "sell" is defined under state privacy laws such as the Texas Data Privacy and Security Act (TDPSA) or the California Consumer Privacy Act (CCPA/CPRA), and we do not share it for cross-context behavioral advertising.

5. When your child writes back

Part of the Daakiya experience is that your child can write a letter back to Amaya by mail. Because this arrives as physical mail addressed to our team, a real person opens and reads it in order to personalize future letters. We treat these letters as private correspondence between your child and Amaya:

• We do not publish, photograph, or share the contents of a child's letter publicly, including on social media or in marketing, without a parent's separate, explicit opt-in consent, and even then we would never include your child's photo, full name, or home address.
• If something your child writes gives our team genuine reason for concern about their immediate safety or wellbeing, we may reach out to the parent or guardian on file and, where we have a legal obligation to do so or believe a child may be in danger, we may report it to the appropriate child-welfare or emergency authorities, consistent with applicable mandatory-reporting laws. Daakiya is an entertainment and creative correspondence service, not a counseling, medical, or crisis service, and Amaya's letters are fictional.
• We keep physical letters only as long as reasonably needed to personalize the next letter and for a limited retention period afterward, then securely dispose of them.

6. Cookies and analytics

We use cookies and similar technologies on daakiya.ink to keep the site working, remember your cart and account, and understand how visitors use the site. You can control cookies through your browser settings; disabling them may affect how the site functions. We do not currently respond to legacy browser "Do Not Track" signals, as there is no accepted industry standard for interpreting them.

7. Data retention

We keep personal information for as long as your subscription is active, and for a limited period afterward to handle returns, disputes, legal, and accounting requirements, after which we delete or de-identify it. Children's personal information is retained only as long as needed for the purpose it was collected for, and is deleted sooner upon a parent's request where we are not otherwise required to keep it.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including relying on PCI-compliant payment processors so we never store full payment card numbers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Your rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of the personal information we hold about you or your child, to opt out of marketing communications, and additional rights under state privacy laws.

Texas residents. Under the TDPSA, Texas residents have the right to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising, the sale of personal data, and profiling. Because children's information is treated as sensitive data under the TDPSA, we only collect and process it with the consent described above. As a small business, Daakiya currently qualifies for the TDPSA's small-business exemption.

Texas SCOPE Act. The Securing Children Online through Parental Empowerment Act imposes additional obligations on digital service providers used by known minors under 18, subject to a small-business exemption. Daakiya currently qualifies for that exemption, but because we serve children we already follow several of the Act's core protections as standard practice: no targeted advertising to children, no collection of precise geolocation data from children, no direct financial transactions by children on our site, and no sale or sharing of children's data. If Daakiya grows beyond the small-business threshold, we will update our practices and this policy.

Other US states. If you live in California or another state with a comprehensive privacy law, you may have similar rights under that state's law.

International (UK and EU). You may also have rights under the UK or EU GDPR, including the right to object to or restrict certain processing and to lodge a complaint with your local data protection authority.

To exercise any of these rights, contact support@daakiya.ink. We may need to verify your identity, and for a request about a child your status as their parent or guardian, before completing the request.

10. International data transfers

Daakiya operates from the United States, and information we collect, including from customers outside the US, may be stored and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you understand your information will be transferred to and processed in the US.

11. Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, especially any that affect how we handle a child's information, we will notify subscribers by email and update the date above before the changes take effect.
